Intro

Malaysia’s Personal Data Protection Act 2010 does not apply in exactly the same way to every organisation or every activity.

This assessment asks a focused series of factual questions about your organisation and the particular processing activity you are assessing. Based on your answers, it provides a preliminary indication of whether the PDPA is likely to apply, the role your organisation may be performing, the obligations that may require attention and the areas that may need legal review.

The tool is designed to make the first-stage PDPA analysis easier to understand without requiring the user to interpret legislation themselves.

Who should use this tool

Use this assessment if your organisation:

• collects or stores information about identifiable individuals;

• uses customer, employee, supplier or website-user data;

• sends personal data to service providers or overseas recipients;

• processes data for another organisation;

• decides why or how personal data is used;

• is unsure whether registration, a Data Protection Officer, breach notification or other requirements may apply; or

• wants a preliminary view before commissioning a broader PDPA review.

Information to prepare

You do not need to prepare legal documents before starting. You should, however, know enough about the activity being assessed to answer questions such as:

• what type of organisation or activity you are assessing;

• whether personal information about identifiable individuals is processed;

• whether the processing relates to a commercial activity;

• whether the organisation decides why or how the information is used;

• whether it processes data for another organisation;

• whether the activity has a Malaysian connection;

• whether sensitive or financial information is involved;

• approximately how many individuals are affected where relevant;

• whether information is transferred outside Malaysia;

• whether the organisation falls within a regulated or prescribed sector; and

• whether a personal-data breach may have occurred.

If you are unsure about a factual answer, select the uncertainty option where available rather than guessing.

What the result helps you understand

Depending on the answers given, the result may help you understand:

• whether the PDPA is likely to apply;

• whether it is likely not to apply to the activity assessed;

• whether the answer is conditional or requires further legal review;

• whether your organisation may be acting as a data controller, processor or both;

• what PDPA obligations may require attention;

• whether sensitive data, DPO, registration, cross-border, sector-Code or breach issues may be relevant;

• potential legal exposure where the facts indicate a specific compliance problem; and

• practical next steps for the organisation.

What the tool does not determine

The assessment does not certify that an organisation is fully PDPA-compliant. It does not replace a full review of privacy notices, internal policies, contracts, security measures, retention practices, consent processes, data-subject procedures, vendor arrangements or actual processing operations.

It is also not intended to resolve facts that require investigation or legal interpretation where the user does not have sufficient information.

Why legal review may still be useful

PDPA compliance depends not only on whether the Act applies, but on how personal data is actually collected, used, disclosed, stored, protected and transferred.

Where the result identifies uncertainty, elevated risk or a specific compliance issue, a legal review can confirm the organisation’s position and convert the preliminary assessment into an actionable compliance plan.
